MILTRADERS LLC-FZ — Legal
MILTRADERS LLC-FZ (hereinafter “MILTRADERS”, “we”, “our” or “the Company”) has made every possible effort to present this Risk Disclosure Statement in clear and understandable language. This Risk Disclosure Statement must be read in conjunction with the following documents: the applicable MILTRADERS Use Agreement (the MILTRADERS Evaluation Agreement, covering the Zero and Pro programs, or the MILTRADERS Funded Account Agreement, as applicable), the Website Terms of Use, and the Privacy Policy. These documents contain additional disclaimers, limitations of liability, and dispute resolution conditions governing your relationship with MILTRADERS. However, neither this Risk Disclosure Statement nor the related documents (including the Evaluation Agreement, the Funded Account Agreement, the Privacy Policy, the Terms of Use, the Trading Rules, or the FAQ) can exhaustively detail all potential risks associated with trading, the use of our Services, or financial markets in general. By using MILTRADERS Services, you acknowledge and accept these risks in their entirety. Capitalized terms not defined in this Statement have the same meaning as attributed to them in the applicable Use Agreement (Evaluation Agreement or Funded Account Agreement).
MILTRADERS is a company organized and operating under the laws of the United Arab Emirates. The Company is incorporated as a Limited Liability Company (LLC) and is registered at Meydan Free Zone, Dubai, UAE. Business License Number: 2643914.01.
The Services offered by MILTRADERS are not directed towards, nor intended for, residents of countries or jurisdictions where such use would violate local laws or regulations. Although our Services are accessible from many countries, users who are not residents of the United Arab Emirates are responsible for complying with their own local laws. Access to MILTRADERS Services in violation of applicable local regulations in your country of residence is strictly prohibited. If you are uncertain about the legality of using our Services in your jurisdiction, you must consult a local legal advisor before creating an account or using our Services. MILTRADERS reserves the right to limit, at its sole discretion, the provision of its Services, in whole or in part, to any person or geographic area, particularly in cases of legal or regulatory restrictions.
MILTRADERS is NOT: a broker-dealer; a futures commission merchant; an investment advisor; a portfolio manager; an investment service provider within the meaning of European regulation (MiFID II); or any other similar financial institution. MILTRADERS is NOT regulated by financial regulatory authorities, including: the Securities and Exchange Commission (SEC) of the United States; the Commodity Futures Trading Commission (CFTC) of the United
States; the Autorité des Marchés Financiers (AMF) of France; the European Securities and Markets Authority (ESMA); the Financial Conduct Authority (FCA) of the United Kingdom; or any other financial regulatory authority. MILTRADERS does not offer investment opportunities and does not solicit funds for investment purposes. We do not manage client capital and do not provide brokerage or order execution services on real financial markets. MILTRADERS operates as an educational and trading simulation services company, providing a training and assessment environment for traders wishing to demonstrate their skills.
MILTRADERS provides access to a fully simulated trading environment via third-party platform operators (Volumetrica, dxFeed, or any other provider selected by MILTRADERS), intended exclusively for educational purposes and for the assessment of trading performance according to predefined rules and criteria. Users pay one-time fees (Evaluation Fees, Resets, or Instant purchases — no subscription and no recurring charge of any kind) to access the Program and Services, but never deposit real funds into the trading accounts themselves and do not trade with their own capital.
All trades executed in Evaluation Accounts (Zero and Pro Evaluations) and Performance Accounts (Funded Accounts / PA) are simulated and do not involve real funds. Characteristics of MILTRADERS accounts: users never deposit funds into a trading account; users do not trade using their own capital; all orders are executed in a simulation environment (TEST Server); no orders reach real financial markets; market data used is real, but execution is simulated; profits and losses displayed are virtual and exist only in the simulation environment.
Participation in the MILTRADERS Program does not guarantee: access to a Funded Account (Performance Account); receipt of rewards or payouts (profit withdrawals); continued use of the platform; or validation of your Evaluation even if you reach the profit target. REWARDS FROM PERFORMANCE ACCOUNTS (PAYOUTS) ARE NOT GUARANTEED. Payouts are subject to full compliance with the conditions, rules, and payout formula set forth in the MILTRADERS Funded Account Agreement, to identity verification (KYC), and to the solvency provisions of the applicable Agreements. MILTRADERS may refuse validation of an Evaluation or deny a payout where the conditions of the applicable Agreement are not met; ANY SUCH REFUSAL IS COMMUNICATED TOGETHER WITH THE CATEGORY OF GROUNDS RELIED UPON, and you may request one internal review in accordance with the applicable Agreement. The decision issued after internal review is final at the internal level, without prejudice to the dispute resolution provisions of the applicable Agreement.
Simulations may not reflect real trading conditions, particularly regarding: A. Liquidity. In simulation, your orders are always executed instantly at the displayed price. In real markets, there may not be enough buyers or sellers at your desired price, and large orders can move the market against you. B. Slippage. In simulation, slippage is minimal or nonexistent. In real markets, your order may be executed at a different price (often less favorable) than the one displayed, particularly during periods of high volatility, major economic announcements, or market opens/closes. Slippage can be several ticks, or even several points, in fast markets. C. Execution Speed. In simulation, orders are executed almost instantly. In real markets, there may be execution delays due to network latency, order queues, or technical issues. These delays can lead to executions at unfavorable prices.
D. Volatility and Market Conditions. Simulations may not accurately reproduce extreme market conditions (flash crashes, price gaps, illiquid markets). Real conditions can be much more difficult and unpredictable than what you experienced in simulation. E. Psychological and Emotional Factors. Trading in simulation carries no real financial risk for you. Trading with real money involves emotional stress, psychological pressure, and fear of loss which can significantly affect your trading decisions. Performance in simulation does not predict your ability to manage your emotions and stick to your trading plan in real conditions.
Trading financial instruments such as futures contracts, forex, and other derivative products involves significant and substantial risks and is not suitable for all participants. Trading on real financial markets can lead to substantial losses, or even the total loss of invested capital. Even when participating via a simulated account or a proprietary account funded solely with Company capital (and not your own money), the nature of trading carries inherent risks and a high risk of loss. You should never trade with money you cannot afford to lose. If you decide to trade on real markets with your own capital (outside of MILTRADERS), you must be fully aware that you could lose your entire initial investment, and in some cases (notably with leverage), your losses could exceed your initial investment.
Performance achieved in one environment (simulation) does not guarantee similar results in another environment (real trading), and past performance is not indicative of future results. Although no real money is used in MILTRADERS simulated accounts, trading activity reflects real market conditions (real price data, real volatility, real market hours). However, differences in execution, slippage, liquidity, and psychological factors can lead to very different results when trading with real money. You are solely responsible for your trading decisions and their results, whether in simulation or in real trading with your own capital.
The ability to withstand losses or to adhere to a particular trading program in spite of trading losses are material points which can also adversely affect actual trading results. Fear, greed, hope, and other human emotions can lead to irrational decisions that would not occur in simulation. BECAUSE THESE TRADES HAVE NOT ACTUALLY BEEN EXECUTED ON REAL MARKETS, THESE RESULTS MAY HAVE UNDER-COMPENSATED OR OVER-COMPENSATED FOR THE IMPACT, IF ANY, OF CERTAIN MARKET FACTORS, SUCH AS LACK OF LIQUIDITY, SLIPPAGE, ORDER REJECTIONS, OR REQUOTES. HYPOTHETICAL PERFORMANCE RESULTS HAVE MANY INHERENT LIMITATIONS, SOME OF WHICH ARE DESCRIBED BELOW. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN. IN FACT, THERE ARE FREQUENTLY SHARP DIFFERENCES BETWEEN HYPOTHETICAL PERFORMANCE RESULTS AND THE ACTUAL RESULTS SUBSEQUENTLY ACHIEVED BY ANY PARTICULAR TRADING PROGRAM. ONE OF THE LIMITATIONS OF HYPOTHETICAL PERFORMANCE RESULTS IS THAT THEY ARE GENERALLY PREPARED WITH THE BENEFIT OF HINDSIGHT BIAS. IN OTHER WORDS, STRATEGIES MAY APPEAR TO WORK PERFECTLY IN SIMULATION OR BACKTEST BECAUSE THEY WERE OPTIMIZED ON HISTORICAL DATA, BUT THEY MAY FAIL IN UNPREDICTABLE FUTURE MARKET CONDITIONS. IN ADDITION, HYPOTHETICAL TRADING DOES NOT INVOLVE FINANCIAL RISK, AND NO HYPOTHETICAL TRADING RECORD CAN COMPLETELY ACCOUNT FOR THE IMPACT OF FINANCIAL RISK IN ACTUAL TRADING.
Simulations may present ideal execution conditions that never occur in real trading. For example, in simulation, you can always enter and exit exactly at the price you wish, which is rarely the case on real markets, particularly during periods of high volatility. NO REPRESENTATION IS BEING MADE THAT ANY ACCOUNT WILL OR IS LIKELY TO ACHIEVE PROFITS OR LOSSES SIMILAR TO THOSE SHOWN OR DISPLAYED. THERE ARE NUMEROUS OTHER FACTORS RELATED TO THE MARKETS IN GENERAL OR TO THE IMPLEMENTATION OF ANY SPECIFIC TRADING PROGRAM WHICH CANNOT BE FULLY ACCOUNTED FOR IN THE PREPARATION OF HYPOTHETICAL PERFORMANCE RESULTS, AND ALL OF THESE FACTORS CAN ADVERSELY AFFECT ACTUAL TRADING RESULTS. These factors include, but are not limited to: changes in market conditions, unpredictable geopolitical events, regulatory changes, failures of financial institutions, economic crises, pandemics, and any other force majeure event.
User testimonials, payout examples (profit withdrawals), case studies, and results displayed on our Site or in our marketing communications may not be typical or indicative of future results. Testimonials reflect the experiences of individual users and may not be representative of the experience of all users. These results were achieved in simulated environments and do not reflect real trading with personal financial risk. There is no guarantee of similar results. Success in trading or in MILTRADERS evaluations depends on individual skills, experience, discipline, risk management, market conditions, and strict adherence to program rules. Testimonials do not constitute a promise or guarantee of future performance. They are provided solely as examples and inspiration, and should not be interpreted as an indication that you will achieve similar results.

This disclaimer of warranties applies to the fullest extent permitted by applicable law.
MILTRADERS does not guarantee that the Services, the Site, the servers hosting the Site, or the trading platforms will be: secure against any intrusion or cyberattack; available uninterrupted or without technical interruption; free from errors, bugs, or malfunctions; or free from viruses, malware, or other harmful components. Use of the MILTRADERS Website, its tools, technology, and Services is entirely at your own risk. You acknowledge and accept that MILTRADERS cannot be held responsible for any damage, loss, or harm resulting from your use or inability to use our Services.
You are responsible for obtaining and maintaining any telecommunication equipment, internet connection, computer (hardware and software), and any other equipment necessary to access and use the information, products, or Services offered by MILTRADERS. MILTRADERS does not provide computer, internet connection, or technical equipment. You must ensure that your equipment is compatible with our Services and meets minimum technical requirements. Any problem related to your personal equipment is your sole responsibility.
MILTRADERS is not, and does not act as, a licensed financial advisor, broker, portfolio manager, or similar financial institution. MILTRADERS does not determine whether a particular trading strategy, specific trading instrument, futures contract, or any other financial product is suitable for a given individual. You must conduct your own due diligence, consult qualified professionals, and assess for yourself whether futures trading and participation in the MILTRADERS Program are appropriate for you, taking into account: your experience and knowledge in trading; your financial situation and available resources; your risk tolerance and ability to bear losses; your financial goals
and time horizon; and any other relevant personal circumstance.
There is no assurance that you will achieve profits or limit your risks based on information, products, tools, strategies, or Services offered by MILTRADERS. Trading always involves a risk of loss, and no strategy, tool, or method can eliminate this risk. You must always trade with caution, use appropriate risk management, and never risk more than you can afford to lose. Always consult a licensed financial advisor before making any financial decision, particularly if you are considering trading on real markets with your own capital.
Electronic trading involves numerous interdependent systems, including computer hardware, software, telecommunication systems, cable or fiber optic connections, power generation systems, remote servers, and internet infrastructure, all being subject to failures or malfunctions that can adversely affect your ability to access your User Admin Account or Trading Account. Internet outages, computer crashes, website or software crashes, network connectivity issues, technical malfunctions, power outages, and third-party service failures are to be expected and may limit or prevent your access to your User Admin Account or Trading Account.
If you are unable to access your Trading Account for any reason (technical failure, internet connection problem, platform malfunction, server maintenance, cyberattack, or any other cause), you will not be able to enter new orders, cancel existing orders, or modify open orders. This inability to access may result in a violation of one or more Trading Rules set forth in your Agreement (e.g., EOD Drawdown violation if an open position moves unfavorably and you cannot close it, or violation of the mandatory closure rule before 4:59 PM ET if you cannot access your account to close your positions). Any violation of Trading Rules, regardless of cause, may result in penalties associated with that violation, including but not limited to Evaluation failure, Funded Account closure, loss of all profits, payout denial, or banning, in accordance with the applicable Agreement (which requires that any such sanction be communicated with the category of grounds relied upon). MILTRADERS IS IN NO WAY RESPONSIBLE OR LIABLE FOR ANY EFFECT ON YOUR ABILITY TO TRADE IN ANY CIRCUMSTANCE, WHETHER DUE TO TECHNICAL ISSUES ON OUR END, ISSUES AT OUR THIRD-PARTY SUPPLIERS, ISSUES ON YOUR END (YOUR INTERNET CONNECTION, YOUR COMPUTER), OR ANY OTHER CAUSE.
Trading during certain specific market conditions, such as periods of high volatility, limit moves, opening price gaps, major economic announcements (NFP, FOMC, CPI), or exceptional market events, presents significant risks and can lead to computer crashes, platform failures, delays in data feeds, or execution impossibilities. If there is a limit move day on a market you are trading, you might not be able to close an existing position because there is no counterparty available at the limit price. In this case, your Evaluation Account (Zero or Pro) or Performance Account (Funded Account) could be liquidated automatically by the system, potentially resulting in an EOD Drawdown violation and closure of your account. The Company will not be responsible for such results and disclaims all liability for losses, rule violations, or account closures resulting from exceptional market conditions or technical limitations beyond our control.
As stated in the MILTRADERS Agreements (Evaluation Agreement and Funded Account Agreement), trading is strictly intraday and all positions must be closed manually before 4:59 PM ET (Eastern Time). Positions not manually closed before 4:59 PM ET will be automatically closed by the system at 5:00 PM ET. This automatic closure can result in: unfavorable slippage (execution at a less favorable price than the market price at the moment
you should have closed); additional losses if the market moves rapidly against you between 4:59 PM ET and 5:00 PM ET; and an EOD Drawdown violation if the automatic closure results in a loss that brings your closing balance below the minimum allowed threshold. SLIPPAGE AND THE CONSEQUENCES OF AUTOMATIC CLOSURE ARE ENTIRELY YOUR RESPONSIBILITY. YOU ARE SOLELY AND UNIQUELY RESPONSIBLE FOR CLOSING YOUR POSITIONS BEFORE MARKET CLOSE. MILTRADERS DISCLAIMS ALL LIABILITY FOR LOSSES, VIOLATIONS, OR ACCOUNT CLOSURES RESULTING FROM AUTOMATIC CLOSURE.
You assume full responsibility for your use of MILTRADERS Services. No statement, no material, no content on the platform, in agreements, or in communications constitutes a guarantee, assurance, or investment solicitation. Use of Services is entirely at your own risk. You acknowledge and agree that you are solely responsible for: your trading decisions (opening and closing positions, instrument selection, position sizing, risk management); your compliance with Trading Rules set forth in the Agreements; your account management (closing positions before 4:59 PM ET, respecting EOD Drawdown, respecting consistency rules); and the consequences of your decisions, whether positive (profits) or negative (losses, violations, account closure).
You understand and accept that MILTRADERS does not represent or warrant that any trading platform will be free from errors, bugs, malfunctions, or technical issues. Trading platforms (provided by Volumetrica, dxFeed, or any other provider selected by MILTRADERS) may experience technical issues, service interruptions, price display errors, delays in data feeds, or any other malfunction.
You understand and accept that MILTRADERS does not manage any trading platform and does not directly provide market data. Trading platforms and data feeds are provided by independent third parties (Volumetrica, dxFeed, or any other provider selected by MILTRADERS). MILTRADERS acts solely as an intermediary providing access to these third-party platforms within the scope of its evaluation and funding program. MILTRADERS does not represent or warrant that market data will be correct, timely, complete, or useful for any particular purpose. Data may contain errors, delays, inaccuracies, or omissions. You should not rely solely on displayed data without independent verification.
To the fullest extent permitted by applicable law, MILTRADERS and its officers, directors, employees, agents, subcontractors, affiliates, partners, and service providers (collectively, “Affiliated Parties”) shall not be liable to you or third parties, and shall have no liability whatsoever, for: A. Any loss arising from or related to a cause over which MILTRADERS or its Affiliated Parties do not have direct control, including but not limited to: failure of electronic or mechanical equipment; failure of communication lines or telecommunication systems; telephone or interconnection problems; third-party trading platforms (Volumetrica, dxFeed, or any other provider selected by MILTRADERS); unauthorized access, computer hacking, or data theft; operator errors or human errors; government or regulatory restrictions; force majeure events (earthquakes, floods, severe or extraordinary weather conditions, epidemics or pandemics, natural disasters or other acts of God, fires, acts of war, terrorist attacks, insurrections, riots, strikes, labor disputes or similar problems, accidents, government actions, communication system failures, electrical system or software failures); and decisions, rules, or trading suspensions of exchanges or markets for any reason whatsoever. B. All special, indirect, incidental, consequential, or punitive damages (including but not limited to loss of profits, trading losses, lost earnings, loss of data, loss of business opportunities, or any other economic damage) that you may suffer in connection with your use of this Site or Services provided by MILTRADERS, even if Affiliated Parties have been advised of the possibility of such damages. This limitation of liability applies regardless of the
legal basis of the claim (contract, tort, negligence, strict liability, or any other legal theory).

FURTHERMORE, MILTRADERS MAKES NO REPRESENTATION OR WARRANTY THAT: THE SITE OR SERVICES WILL BE UNINTERRUPTED, CONTINUOUSLY AVAILABLE, OR ERROR-FREE; DEFECTS OR ERRORS WILL BE CORRECTED WITHIN A SPECIFIC TIMEFRAME OR WILL BE CORRECTED AT ALL; THE SITE OR SERVERS MAKING THE SITE AVAILABLE ARE FREE FROM VIRUSES, MALWARE, OR OTHER HARMFUL COMPONENTS; RESULTS OBTAINED THROUGH USE OF THE SITE OR SERVICES WILL BE ACCURATE, RELIABLE, OR SATISFACTORY; OR THAT THE QUALITY OF ANY PRODUCT, SERVICE, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED
VIA THE SITE WILL MEET YOUR EXPECTATIONS. This disclaimer of warranties applies to the maximum extent permitted by applicable law.
YOU UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MILTRADERS AND ITS OFFICERS, DIRECTORS, AGENTS, SUBCONTRACTORS, SUBSIDIARIES, JOINT VENTURES, EMPLOYEES, PARTNERS, SERVICE PROVIDERS, AND AFFILIATES (COLLECTIVELY, “AFFILIATED PARTIES”) SHALL NOT BE LIABLE TO YOU OR THIRD PARTIES FOR THE CAUSES AND CATEGORIES OF DAMAGES SET OUT IN ARTICLE 9.4 ABOVE, WHICH APPLIES IN FULL TO THIS ARTICLE, regardless of the legal theory on which the claim is based, whether contract, tort (including negligence), strict liability, warranty breach, misrepresentation, or any other legal theory. Nothing in this Statement excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation.
In all cases, MILTRADERS' total and cumulative liability to you for all claims arising from or related to the Services shall not exceed the total amount of fees you have actually paid to MILTRADERS during the twelve (12) months preceding the event giving rise to the claim, in accordance with the applicable Use Agreement. For example, if you paid $129 USD in Evaluation Fees over the last twelve months, MILTRADERS' maximum liability to you would be $129 USD, regardless of the nature or magnitude of your claim.
All rights not expressly granted in this Risk Disclosure Statement, in the Use Agreements (Evaluation Agreement and Funded Account Agreement), or in any other contractual document are reserved by MILTRADERS. Nothing in this Statement should be interpreted as granting, by implication, estoppel, or otherwise, any license, right, or interest whatsoever in or to intellectual property rights, trademarks, technologies, or assets of MILTRADERS.
